1.1 The Credit Monitoring Services Services are provided by Pillar Labs Ltd (“Pillar”, “we”, “us”, “our”), authorised and regulated by the Financial Conduct Authority (“FCA”) under firm reference number 996727. Pillar is a wholly owned subsidiary of Pomelo Technology US Inc.
1.2 You may only access the LemFi Credit Monitoring Services via the LemFi Mobile App which is owned and licensed by Pomelo Technology US Inc.
2.1 The Credit Monitoring Services allows you to view information that the Credit Reference Agency holds about you, including:

5.2 Free Service Criteria
The Credit Monitoring Services are provided as free of charge to active LemFi Customers. To retain access to the free Credit Monitoring Services, you must have completed at least one of the following actions as a LemFi Customer in the last sixty (60) days :
If you do not meet the Free Service Criteria, your access to the Credit Monitoring Services will be paused until you meet the Free Service Criteria again, or you may be required to pay for the Credit Monitoring Services (whichever is applicable).
6.1 Neither Pillar nor any Credit Reference Agency makes any warranty, confirmation, implication, or representation regarding the following:
6.2 We and the Credit Reference Agency will use reasonable efforts, but we do not guarantee that all information is always up to date, accurate or verified by us.
6.3 Your credit scores and credit reports are provided for personal and educational purposes only and do not guarantee that you will be accepted for credit.
6.4 You acknowledge that your credit scores and credit reports will only be viewed and accessed through the LemFi Mobile App, and they are not available for download and cannot be provided by us in a document format.
7.1 If you believe there is an error in your credit report, contact the relevant Credit Reference Agency directly to address your dispute.
8.1 The Credit Monitoring Services are currently free of charge. If we decide to introduce a fee in the future, we will let you know in the LemFi app or by email before it applies. You will be able to choose whether to continue using the Credit Monitoring Service or opt out.
8.2 Where applicable and relevant, you authorise Pillar to collect payments for your use of the Credit Monitoring Services. Please note that payments made for credit reports services are not refundable. This is because our system requests and prepares each credit report on an individually bespoke and customised basis. The supply of such services falls under exemptions as defined in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
9.1 These Terms are a contract between you and us. If any part of these Terms is held by any competent authority to be invalid or unenforceable, the validity and enforceability of all other parts of these Terms shall not be affected. These Terms do not give any third party any rights under the Contracts (Rights of Third Parties) Act 1999. No third party shall have any rights to enforce any of these Terms.
9.2 You agree to receive all communications from us related to Credit Monitoring Services.
9.3 The information we provide may not be identical to that which can be obtained elsewhere and you may obtain from the Credit Reference Agency individual credit scores and credit reports other than through our Credit Monitoring Services.
9.4 We will take reasonable steps to protect your information and deliver the Credit Monitor service. However, we cannot be responsible for events outside our reasonable control, including interruptions in supplier services (such as Equifax) or unauthorised access caused by third-party criminal activity. You must keep your login details safe, not share your account with anyone else, and not resell or distribute any information provided through Credit Monitor.
9.7 We rely on our suppliers to provide information to us on demand. This means that if a supplier is unable to provide information to us, we may not be able to provide the Services to you. While we will use reasonable efforts to supply information, we cannot guarantee the continued availability of any or all of our Services.
9.8 We continually try to improve the Services we offer, and you agree that we may change the contents of credit reports or any other reports, these Terms, the suppliers of information, and any other aspects of our products and services without notice. You accept that you will be bound by any changes to these Terms. We will notify you of any changes by updating the date of the latest revision of these Terms. Changes take effect immediately when posted on our LemFi Mobile App or communicated through email. You agree to check these Terms in the LemFi Mobile App from time to time to take notice of any changes that are made to these Terms.
9.9 You acknowledge that we may be required to reveal information about you or your credit reports under compulsion of law or by a Court Order. In all other cases we shall keep your information confidential unless you agree otherwise.
10.1 You can stop using the Credit Monitoring Services Services at any time in the LemFi Mobile App.
10.2 We may suspend or end your access to the Credit Monitoring Services if:
12.1 The Credit Reference Agency owns the rights in the credit scores and credit reports.
12.2 Pillar and its parent company Pomelo Technology US Inc. own the rights in the LemFi Mobile App and in the way the information is presented to you, including all features, content, functionality and the underlying technology associated with the Credit Monitoring Services.
14.1 These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the laws of England and Wales.
14.2 If you feel that we have not met your expectations in the delivery of our services or if you think that we have made a mistake, please get in touch with us. We have internal procedures for handling complaints fairly and promptly. We will send a final response to your complaint by the end of 15 business days after the day on which we received the complaint. In exceptional circumstances, where we cannot send a final response within this period of time for reasons beyond our reasonable control, LemFi shall send a final response to you within 35 business days of the day on which we received the complaint.
14.3 If you are still not happy once LemFi has responded to your complaint, there are options open to you. If you are an eligible complainant (i.e. you are acting for purposes which are wholly or mainly outside your trade, business, craft, or profession) and your complaint falls within the Financial Ombudsman Service’s jurisdiction, you may be able to take your complaint to the Financial Ombudsman Service. Further information on eligibility criteria and the procedures involved in referring your complaint to the Financial Ombudsman Service are available on the following weblink (http://www.financial-ombudsman.org.uk).
14.4 Other Dispute resolution - Any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms which cannot be satisfactorily settled by the parties through other means of dispute resolution shall be finally settled by arbitration upon the written request of either party, in accordance with the rules of the London Court of International Arbitration. The place of arbitration shall be London, England. The arbitration proceedings shall be conducted in English by a single arbitrator. The award shall be final and binding upon both parties subject to applicable laws and regulations.
