1. OVERVIEW
1.1. The following terms and conditions (the “Referral Terms & Conditions”) govern the terms under which Money may be earned by our existing customers (“Referer”) when they introduce new customers (“Invitee”) who download the LemFi App and subsequently send money internationally collectively (the "Referral Programme"). The Referral Terms & Conditions apply when the Referer and the Invitee use the LemFi App.
1.2. By signing up for the LemFi App and Services, and participating in the Referral Programme for example by making a referral or using a referral code, you agree to be a participant in the Referral Programme and bound by this Referral Terms & Conditions. If you do not wish to be bound by the Referral Terms & Conditions, do not share your referral code. The language of this Referral Terms & Conditions are in French and English including all Services, instructions and transactions carried out.
1.3 This Referral Programme is offered by Pomelo Remits Europe Ltd.
2. PARTICIPATING IN THE REFERRAL PROGRAMME
2.1. The Referral Programme enables you to earn money (“Money”) for performing or participating in the Qualifying Referral Program Activities (”QRPA”).
2.2 A list of QRPA’s are included below (as amended from time to time) , LemFi may add temporary or permanent QRPA’s as part of promotional Referral Programmes at its sole discretion.
2.3 QRPA’s dates of any applicable promotional period; and any terms and conditions specific to new QRPA’s shall be subject to (“Additional Terms”) included in any promotional materials published for the relevant promotional Referral Programme, including and/or via the relevant social media platform(s), and the LemFi website, LemFi App used to run the Referral Programme (as applicable).
2.4. Qualifying Referral Program Activities (“QRPA”): A Participant shall receive 10 Euro (“Cash Back”) for the following QRPA’s:
Existing LemFi Customer (as applicable):
provides a valid and eligible promotional code to the Invitee (new customer) which is then used by the Invitee to: (i) download and use the LemFi App as a new customer; (ii) the Invitee, successfully transfers a minimum of 50 Euro from their LemFi account under a single money transfer transaction to any other person (other than themselves); (iii) such money transfer is permitted by LemFi App from any European Union Countries (where LemFi so permits); and (iv) the money transfer complies with the LemFi General Terms and Conditions of Services resulting in the Referrer being entitled to 10 Euro.
New Customer:
Where an Invitee (new customer) participates in: (i) downloading of the LemFi App; (ii) uses the Referer’s code; (iii) subsequently and successfully transfers minimum of 50 Euro under a single transaction, (iv) the Invitee complies with LemFi’s Terms & Conditions of Services resulting in being entitled to 10 Euro.
2.5. Other Rewards: The amount and nature of the Reward for each new promotion may differ which will be disclosed in the App along with additional or separate QRPA as announced during any promotional period. .
2.6. LemFi reserves the right to impose and/or change minimum transfer limits at its discretion. Where a minimum transfer limit is in place, only transfers that exceed this limit will constitute valid QRPA. If a promotional Referral Programme is being run, the relevant QRPA must be completed during the promotional period to qualify.
2.7. LemFi reserves the right to change the list of QRPA’s and associated Rewards at its sole discretion without prior notice. However, existing QRPA’S validly completed before the date of the change will be honored by LemFi.
2.8. Where not in conflict with any Additional Terms, the terms of this Referral Agreement will govern any Referral Programme. Where there is a conflict between the Additional Terms and the terms of this Referral Agreement, the Additional Terms shall take precedence.
2.9. Any money earned will be awarded directly to your LemFi account against the customer’s future transactions. The money earned is not transferable, refundable or exchangeable for any other award.
2.10 The Referer confirms that they valid consent to invite the Invitee under the Referral Programme.
2.11 Any money earned by the Referer or the Invitee can only be used to offset against future money transfers.
3. PROGRAMME RESTRICTIONS
3.1. Participants are required to register with LemFi Service. Only one registration per Participant will be accepted.
3.2. Subsequent registrations or money transfers with LemFi by the Invitee do not qualify as Valid Referrals.
3.3. Money transfers initiated by the Invitee after his or her first successful money transfer with LemfI APP, or referrals to an Invitee who is a previous user of the Service, do not qualify as Valid Referrals.
3.4. LemFi App reserves the right to void any QRPA or payment of any Rewards that: (i) appears to be fraudulent; (ii) appears to have been created as a result of a fraudulent transaction; or (iii) that violates the terms of these Referral Terms & Conditions or the LemFi applicable Services Terms & Conditions.
3.5. LemFi reserves the right to limit the number of individuals per household eligible for receiving 10 Euros entitlement under the Referral Program.
3.6. Any attempt by a Participant to abuse this Referral Programme by using multiple/different identities, registrations, logins, and/or any other method LemFi considers abusive, at its discretion, will void and disqualify the Participant from receiving the 10 Euro under the Referral Program at LemFi’s sole discretion.
3.7. Residents of certain countries may be excluded from Referral Programmes where local laws make it necessary. Where applicable, a list of excluded countries will be included in the Additional Terms and/or the materials relating to the relevant Referral Programme.
3.8 Any Rewards earned by the Invitee or the Referer shall be subject to local taxes for which the recipient shall be solely responsible.
4. DELIVERY, USE AND EXPIRATION OF REWARDS
4.1. LemFi will deposit the Reward in your account on the App once the QRPA has been completed. Your Rewards are cumulative and will be displayed as a balance (the “Rewards Balance”) in your account against future transactions.
4.2. LemFi does not guarantee a delivery time on any Rewards granted under any other promotion, where applicable.
4.3. You may apply your 10 Euros against transactions which (i) would be permitted under the LemFi Terms & Conditions of Services ; and (ii) meet the transaction size requirements shown in the App prior to your transaction.
5. LIMITATION OF LIABILITY
5.1. TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTIONS, IN NO EVENT SHALL LEMFI BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES ARISING FROM YOUR PARTICIPATION IN THE REFERRAL PROGRAMME, INCLUDING BUT NOT LIMITED TO SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE AND/OR CONSEQUENTIAL DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LEMFI’S MAXIMUM AGGREGATE LIABILITY TO PARTICIPT AND ANY THIRD PARTY UNDER ANY AND ALL CIRCUMSTANCES SHALL BE THE THEN-CURRENT 10 EURO VALUE OF THE PARTICIPANT’S UNSPENT MONETARY REWARD UNDER THE REFERRAL PROGRAM. .
5.2. ALL WARRANTIES, EXPRESS AND IMPLIED, REGARDING THE REFERRAL PROGRAMME AND USE OF THE LEMFI APP SERVICES ARE DISCLAIMED (INCLUDING, WITHOUT LIMITATION, THE DISCLAIMER OF ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF INTELLECTUAL PROPERTY AND/OR FITNESS FOR A PARTICULAR PURPOSE). LEMFI MAKES NO REPRESENTATION OR WARRANTY WITH RESPECT TO ANY RESULTS OBTAINABLE THROUGH THE REFERRAL PROGRAMME OR THE DELIVERY TIME OF ANY OTHER REWARDS IT MAY PROMOTE.
6. OTHER TERMS AND CONDITIONS
6.1. We reserve the right to amend or terminate the Referral Programme at any time without notice. Resolution of all questions or disputes regarding eligibility for the Referral Programme, earnings of Rewards, or your compliance with the terms and conditions of this Referral Terms & Conditions shall be subject to our reasonable interpretation.
6.2. If a Participant or Invitee attempts to use the Referral Programme in breach of Referral Program Terms & Conditions, the User Agreement or in violation of any law, statute or governmental regulation, we will have the right to suspend or terminate the account under the User Agreement or void the Rewards of either party.
6.3. All information collected in the Referral Programme shall be subject to our Privacy Policy.

7. Jurisdiction
All Participants in the Cash Back Referral Program accept and acknowledge that these Terms & Conditions are subject to laws of England & Wales which shall have exclusive jurisdiction in respect of any claims or disputes.
