1.1 This document (the “Terms”) sets out the terms and conditions for the LemFi loyalty programme (“RemitPoints”). It also sets out other important things that you need to know. These Terms, along with our general terms and conditions that apply to our services, form a legal agreement between you as our Remittance Product Services User (“Customer”) and RightCard Payments Services Ltd (“LemFi”).
1.2 LemFi processes your personal data to provide RemitPoints to you. Some of your personal data may also be shared with third parties (for example, if we allow you to transfer points in, from or out to a third party loyalty program, like a voucher or gift card provider, we will share your name and membership number with them. For more information about how LemFi processes your personal data, please see our Privacy Notice.
1.3 RemitPoints is not a payment service and is not regulated, even though the underlying services the loyalty program is linked to may be regulated.
2.1 RemitPoints is a loyalty programme where you may receive, hold and redeem points (also called RemitPoints). To earn RemitPoints you must use our remittance services and meet the Qualifying RemitPoints criteria, which may entitle you to RemitPoints (as amended from time to time) and subject to our sole discretion.
2.2 We will display the RemitPoints available to you in the LemFiApp which you may redeem subject to our sole discretion. The RemitPoints you earn are loyalty points and not a form of money or currency, and cannot be exchanged for money or currency. RemitPoints can only be redeemed by us and subject to the following limitations:
- RemitPoints are not a form of currency nor a payment method to be used to purchase any goods or services;
- RemitPoints are not accepted by any third party other than anyone designated by us;
- RemitPoints cannot be exchanged for money or any currency;
- RemitPoints are not Electronic Money nor a Payment Service as defined by regulations even if the underlying remittance services used to earn RemitPoints is regulated.
3.1 To become entitled to earn RemitPoints, you must fulfill the following criteria as referred to “Points Receiving Activities”, described below:
- you must be an existing LemFI customer located in United Kingdom;
- use our existing remittance services to send money outside of United Kingdom;
- the value of each of your money transfer transaction must be equal to or greater than £20.00 GBP, which entitles you to earn RemitPoints;
- you are not in breach of our general terms and conditions nor is your account suspended or services have been withdrawn from you at our sole discretion.
- you may also be entitled to receive RemitPoints when you join LemFi as a new customer as a welcome gift.
4.1 We offer for each successful and valid international money transfer equal to or above £20.00 GBP 0.05 RemitPoints. For example, if you send £50.00 GBP, the RemitPoints earned will be: £50×0.05=2.5 points. Therefore, you earn 2.5 points.
4.2 The above formula is applied to each and every transaction you undertake involving transfer of funds outside of the United Kingdom and provided the value of the transaction is equal to or greater than £20.00 GBP.
5.1 RemitPoints are valid for 3 years after they are received and remain subject to any exclusions that may apply as covered under section 7. After this time, the RemitPoints permanently expire and can no longer be redeemed. You can see when your points expire in the LemFiApp.
(We refer to these activities as “Points Redeeming Activities”.)
6.1 The specific Points Receiving Activities and Points Redeeming Activities we offer are set out in the LemFiApp. They may change at any time and can vary between Customers (for example, based on frequency of use of our remittance services or customer location).
6.2 Where we change or remove a Points Receiving or Redeeming Activity, we will try to give you 14 days notice. However, we will not always be able to do so.
6.3 Each specific Points Receiving Activity and Points Redeeming Activity has its own instructions, which are set out in the LemFiApp. Make sure you follow these instructions, otherwise you will not receive or redeem your points.
6.4 The number of points earned or spent on any specific Points Receiving Activity or Points Redeeming Activity varies by activity and may change at any time, but will always be clearly shown to you in the LemfiApp before you undertake the activity.
6.5 Points cannot be earned other than through a Points Receiving Activity and cannot be redeemed other than through a Points Redeeming Activity.
6.6 Generally, you may redeem RemitPoints towards Gift Cards or against any international remittance transactions that you undertake. For example- If you are intending to send £20.00 GBP to Nigeria, you may use £18.00 from your e-wallet and redeem £2.00 worth of accrued RemitPoints to complete the transaction.
7.1 RemitPoints are only available to holders of a payment account with LemFi or those who are our new remittance services customers. Accrued or earned RemitPoints cannot be transferred to another customer. If you or we close your payment account your RemitPoints balance will be forfeited.
7.2 You must activate RemitPoints to use it. If you do not activate RemitPoints, you will not be eligible to earn points or use the RemitPoints features of the LemFIApp.
7.3 You can close your RemiPoints account at any time by contacting Support. If you do, your points balance will be forfeited. You can avoid this by redeeming your points before you close your account.
7.4 We may suspend your access to RemitPoints or reverse any points which have been awarded to you if we believe you have:
- breached these Terms or any other terms that apply to your LemFi account;
- reversed or undone any action which earned you points;
- acted fraudulently or abusively; or
- We have suspended or terminated your account for any reason whatsoever.
We will make this assessment in our sole discretion, acting reasonably. We will notify you of our decision as soon as possible if we intend to suspend or reverse any RemitPoints awarded to you.
Any forfeit of points when your account is closed is permanent, regardless of whether your account is closed by you or by us. You cannot obtain a refund for points you have earned. You can avoid forfeiting your points by redeeming your points before your account is closed.
8.1 RemitPoints cannot be transferred from one customer to another.
8.2. RemitPoints might be subject to various caps, such as earning limit per transaction and per day to prevent abuse.
8.3 RemitPoints might not be awarded if we detect fraudulent activities related to our loyalty program.
8.4 We may set limits to how many RemitPoints you may redeem in a single transaction or a day.
9.1 There are no fees for enrolling in the RemitPoints programme, for Points Receiving Activities, or for holding points.
9.2 If we need to reverse any points which you have already spent, you will need to either purchase or exchange those points or return the benefit you received for those points. For example, imagine we allowed you to use 100 points to receive a discount of £10, leaving you with a points balance of 0. If those 100 points were reversed, you would either need to complete a Points Receiving Activity for 100 points or return the benefit of the discount you received by paying an additional £10.
9.3 Where we take the action to reverse the points (for example, identifying that a transaction on which you earned points was abusive), you authorise us to debit your payment account to return the benefit or to complete a purchase or exchange of the points (whichever is cheapest) on your behalf.
10.1 Changing these Terms
If we make any changes to these Terms, we’ll give you at least 30 days’ notice if the change is disadvantageous to you, and you can close your account if you disagree with the change. However, if the change is to your benefit, we can make those changes immediately.
10.2 How can I complain?
If you’re not happy with the service you’ve received in relation to RevPoints, we’ll do our best to make things right where it’s within our control. If you have a complaint about RevPoints, please reach out to Support and let them know you want to make a complaint. We’ll look into your complaint and try to resolve things via email as soon as we can. However, as RevPoints is not a regulated service, your complaint cannot be treated as a regulated financial services complaint.
10.3 What law applies?
The law that applies to these Terms is that of England and Wales. If you want to take legal action against using the courts, only the courts of England and Wales have jurisdiction.
